    would never be ruled, and if it was, any idiot with a copy of the Canadian Charter of Rights and Freedoms can strike that down in court.

    ANYTHING the HRC/HRT can do is so small-time that it's not worth getting a lawyer over, unless you are trying to make a point (like Ezra, or other conservative bloggers).

              • err -- guys you do understand that most things before human rights commissions have to do with racial or sexual discrimination in the workplace or in the provsiion of services etc etc. Hate speech is a miniscule portion of what they get involved in .

                So asher while your statement about evidence in a hate speech case may be correct in some such cases . . . it would not be correct in many many cases. Take cases that lets say involved termination of an employee who had been off work for years and then complained he was discriminated on due to disability . . . or cases where an employee was terminated from a retail position due to his new religion prohibiting him from working on Saturdays . .. . or cases where the claim was adverse affect discrimination.


                Many many such cases have lots of evidence which may be disputed and complex legal issues.


                To NYE-- to imply these commissions as activists run amuck is generally not accurate. The commissions generally are pretty reasonable in their approach but I will agree that when they get a 'cause', they can become a royal pain in the azz. For the most part I think they fulfill their function which is to provide a forum for these types of issues-- In that they are little different than a landlord-tenant board, a labour relations commission or any other number of regulatory bodies out there. All are designed to deal with numerous issues within a body with specific expertise in the area. Many have looser rules of evidence and procedure. These bodies deal with 99% of the stuff that comes their way efficiently and well. Its the 1% though that you hear about-- where they do something thats on the edge or different.

                Hate speech is just that- its controversial so pretty much every case make the news but its a very small part of what the commissions do

                    Dude, the fact the the HRC system is separate (with lower evidentiary standards than the normal justice system) makes it worse. I can't believe you support this.

                          • Since when does the US have true absolute free speech? There are various types of speech that are banned in this country and carry criminal penalties. You can be summosed for example for disturbing the peace. You can be arrested for incitement to violence or incitement to riot. And of course, don't say **** on prime time broadcast TV...

                            And then you have Sec. 2385 of title 18 of the US code: "Advocating overthrow of Government"


                            Whoever knowingly or willfully advocates, abets, advises, or teaches the duty, necessity, desirability, or propriety of overthrowing or destroying the government of the United States or the government of any State, Territory, District or Possession thereof, or the government of any political subdivision therein, by force or violence, or by the assassination of any officer of any such government; or Whoever, with intent to cause the overthrow or destruction of any such government, prints, publishes, edits, issues, circulates, sells, distributes, or publicly displays any written or printed matter advocating, advising, or teaching the duty, necessity, desirability, or propriety of overthrowing or destroying any government in the United States by force or violence, or attempts to do so; or Whoever organizes or helps or attempts to organize any society, group, or assembly of persons who teach, advocate, or encourage the overthrow or destruction of any such government by force or violence; or becomes or is a member of, or affiliates with, any such society, group, or assembly of persons, knowing the purposes thereof - Shall be fined under this title or imprisoned not more than twenty years, or both, and shall be ineligible for employment by the United States or any department or agency thereof, for the five years next following his conviction.
