    I still don't understand how this would be cruel. Unusual I can understand but cruel?

    Imran's right though. Strange as it may seem to me, the Court already set down the precedent in the previous rape case though and I don't think this is sufficently different on the facts for the Court to ignore the previous case.

        The rationale is this: Killing someone can result in the death penalty. But imposing the death penalty when the defendant did not kill someone is excessive, and excessive punishment is "cruel."

        IIRC, even felony murder (i.e. you're committing a felony and as a result, someone dies -- say, your robbing a bank and your accomplice kills someone), doesn't get YOU the death penalty.

              It´s not as if many inmates of the death row don´t try this repeatedly

              But often enough they will get saved from their suicide attempt and then put into hospital till they´re healthy enough again to wait for their execution

                Yeah, that's about right. Lack of proportionality makes it cruel and unusual, especially when the punishment is death.

                    Honestly we should take a nod from Walker Texas Ranger and start executing people using multiple round house kicks to the face instead of lethal injection. It's a lot more humane.
