I could do so, but I wouldn't. I would say, in a free society, people should be allowed to buy and sell drugs, so I'm voting for freedom. I would vote to nullify, which is, the jury says, we don't agree with this law. Since double jeopardy is unconstitutional, there isn't a lot the courts can do if the jury acquits, unless there's evidence of jury tampering by the defendant, maybe not even then. Plus, while the courts frown on nullification, none have as yet said it's illegal.

Errr yea, are you saying that a society where people can't buy and sell whatever they want is not a free society?

If you live in a market society, yes. If we didn't, the basic assumptions change. However, I also think that the state has no business telling people what they can or cannot put into their own bodies (provided it wouldn't harm someone else, i.e., it ought to be illegal to give yourself smallpox).

You mean, if we live in your strawman of a market society.

So a 'free country' would allow you to buy drugs and not rocket launchers.

I guess the drug dealers are not harming anyone eh?

It does harm others though. Just as smoking, drinking, overeating etc.. Those who do those things take resources because of their sicknesses. For example, a planned economy would have to have more drug rehabilitation centers for those who become addicted to drugs.

Better that than house them in prisons. Furthermore, your argument could be extended to simple existence, as just existing I make resources unavailable to others.

Because you think freedom is working at Wal-mart. And people won't be able to do that anymore.

Yes, Nicaragua was such a dark pit of totalitarianism.

I'm not against giving people treatment for their sicknesses, but when they make themselves sick by their behavior that's unfair because they take up resources from other people. Drug rehabilitation is just one thing people who use drugs need. They also have health problems resulting from their drug use. They will need more health care than other people. Also, drug users are less productive at work. Furthermore, they tend to lose their minds and do things like shoot their loved ones and such. I could go on.

No, everone deserves to exist. People should not be allowed to make themselves sick so that they can use up more resources than everyone else does.
