      It's not the worst, but it is a crime. It's the migratory bird law that will hurt him more.

      Yes it is. But, if he was a good golfer he'd be on the PGA, not the Nationwide Tour.

      4. Where do we draw the line? Is crushing ants the same as this?
      Is breaking a window really breaking and entering?

          Yeah, that struck me as dumb. They might occasionally hit a couple hundred yard hole, but it's impressive when it happens. Holes in One are nearly always from <200 yards, aren't they?

          My feeling was he wasn't trying to kill the bird, but didn't realize how hard a ball would hit a bird from a few hundred feet away. That said, he shouldn't have done it in the first place; but it's certainly not on the scale of the Vick crimes, and putting it in the same sentence lessens Vick's crime and badly exaggerates this one.

                True, but not only was he firing balls at it from a 100 yards away, he stopped and then started again when the bird flew closer.

                That to me says that he intended to kill the bird with golf balls.

                Plus it wasn't just one attempt, I'm sure it took him half an hour to hit the bird. How many balls can you hit in a half an hour on the range?

                  I disagree. I think it was a combination of being immature enough to think the target practice was amusing, and just wanting to scare it off so it would run away. He only hit it once, after all... I love cats and dogs, but if a wild cat/dog started bothering me I could certainly see me throwing pebbles towards it to try and scare it off. I wouldn't try to hit it, and I wouldn't throw them hard enough to hurt them even if I 'missed' and hit it, but certainly animals can bother people. I don't think this is the same category of 'bothering', but I'm also probably rather more mature than said golfer

                    The guy managed to kill a single hawk with a lucky shot and the media is comparing him to Vick, who electrocuted shot and hung an unknown number of dogs that he was training to fight and kill other dogs.

                                14 months Tuberski? That doesn't seem a little much to you? It's not like he was out actually looking for hawks. He did something incredibly stupid and he should be punished for it but 14 months is just insane.
