      Any bragging later is irrelevent. Either what he did AT THE TIME was an assault based on what he was faced with then . . . or it was not.

      Finding out things later or even spouting off your trap like a macho idiot should not matter at all. Its all what was reasonable in the circumstances.

      And in the case of being faced with an intruder in your house, there is no doubt that physical force would be lawful. The only question is did this guy use too much . . . and not just a tiny bit too much but an amount that would be unreasonable in the circumstances

        I disagree. I think it speaks volumes of the guy's character that he seemed very proud/boastful of his actions after. He seems like the kind of guy who will not hesitate to resort to violence, excessive violence, if he has any kind of slight provocation.

              I've a lot more sympathy for a drunken 16 year old than I do for a 30 year old who beats a 16 year old and brags about it.

              I don't consider getting drunk at a party a defect (so long as he doesn't drive after), but I do consider someone as violent as this home owner is to be a great defect.

              It's time for perspective, DinoDoc. I know you're one of those hardcore Christian right-wing "drinking is bad mmkay", but gain that perspective: this man smashed the kids head into the cement. And you take issue with the kid drinking?

                    Because even the guy who beat the kid doesn't say he fought back. His only excuse is it was instinct to beat the kid when he saw him in the basement.

                    I also know from experience how tired/out of it people get when they're drunk, especially after a party is over.

                      It was said earlier the homeowner of the invaded house should have taken the intruder home.
                      Wouldn't it have been nice if the adults at the home of the party had shown that responsibility?
                      I guess they had already demonstrated they weren't that responsible.

                        Usually when there's a house party with teenagers, there are no adults around.

                        I'm also unsure how any adults at the house of the party are responsible for this man's case of assault.

                            According to Canadian law, they had no responsibility to do anything about the kid. At least according to the Canadian Supreme Court.

                            • If they were there at the time of the party they needed to be sure of the attendees guardians approval. They needed to assure moderation and responsibilit ( I know, out of the question), and there or not during the evening, they could have insured that any there had their parents come and get them.

                              I can see throughout this thread that the voice of reason is missing.
                              You can't understand bumping into an intruder in your home, but choose to focus on comments.

                                What you're discussing is a completely different discussion (eg, house parties...)

                                The issue here is the man's reaction to the kid in his basement. His extreme response, for one...and then his braggart comments afterwards. If this wasn't enough, he vocally whined to the media after about the kid not facing serious charges about the incident. He's basically asking for the public to petition the Crown to charge him for assault because:
                                1) He way overreacted
                                2) He caused physical harm to somebody (ears bleeding from blunt force trauma to the head is NOT a good sign)
                                3) He bragged afterwards
                                4) He whined about the kid not doing hard time for the incident
