I don't really see a problem with this is because all parties involved are treating this as a nice to have, not an "Oh my God we have been torturing these poor dudes for years" thing.
Now my suspision is that said muslim petitioners probobly would have resorted to that if they were denied, but they weren't, so we will never know.
