I am a bit confused, but that might be because I am use to the US system.

It is confusing to mix Westminster and other systems.

      The principles are simple.

Under Westminster, Parliament is supreme. 'Constitutions' are usually Acts of Parliament. Parliament could pass a law excluding rights for all except Martians. There would be some protest, and it would be expected that courts would tie them up in knots for long enough to depose the Martian lovers in the next election. (The courts do still play a role). The election is guaranteed by boundaries on time of sitting of Parliament, and those boundaries are supervised by the Crown.

Under a Constitutional system, a document written at some past time, and amended from time time time by powers exceeding those of federal legislators, is the supreme law of the land.

Us crazy Canucks have adopted the best of both worlds! We have a supreme document and a supreme Parliament. there's some jousting from time to time as we grow into it.

        The part where you said:

As a matter of fact, I'm not sure a reversal would even require seperate legislation.

The legislation could contain the amendment reversing Martin's amendment.

'Martin was full of pooh. Therefore we reverse his legislation of such and such a date amending the Constitution of Canada. We know best and we say we can use the NWS clause. So there!

We further consider the SCoC to be full of pooh in the matter of red vs blue and therefore declare that the CHA shall remain in force for the next five years NWS the CoRF.'

Et voila, amendment and NWS in the same bill. Why not? It is within the power of Parliament by the Constitution.

It is, and it isn't. You just have to pay attention.

                      • The short answer is that Parliament can do whatever it likes so long as what it does does not affect individual rights or the position of provinces.

We've set limits to Parliament. That is all.

At least *****ing about SCOTUS decisions don't cause constitutional crises.

                            • I'm not sure what is stuck in your craw, Odin.

Was it the pledge to grant every parent in Canada $100 per month per child to help cover childcare costs?

Was it the pledge to strengthen public healthcare?

Was it the tax cut that even the least advantaged, those who pay no income tax, share in?

What shade of Republican do you see Harper as?

Personally, I'd put Hillary slighty to his right.

                              • to me the biggest thing going on the Canada right now is that the liberals are very corrupt, probably from being in power too long

so I would probably do anything I could to put someone else in power... or vote my positions...

(right now I would vote for almost anyone to take the current US admin out of power)
