In order to keep fluent in Spanish and remain bilingual (never a bad ability to possess), he should be able to speak Spanish at home, of course.
On the other side of the coin, he and his family should have the courtesy and intelligence to learn the language of the country which they have chosen to live, and use it.

The teacher doesn't know what they are saying.

It's more akin to the kid speaking in some made up langauge the kids use, and the teachers telling them not to use it at school, and the kids keep using it.

Outside the class room - in the halls between classes, this is a problem how? Because some kids might plot to do harm? We used to sing a modified Xmas song (I forget which one, this was like 3rd grade) about setting the school on fire IN ENGLISH, IN SCHOOL. Whatever. If kids are gonna plot to come to school with a bunch of weapons to kill everybody, they're gonna do it, and speaking in a foreign language will most likely have nothing to do with it.

All those kids who showed up to school with AK's from their grandfather's militia arsenal were, AFAIK, good 'ole white, English-as-first-language Americans.

And it would look really bad if the plotting was done right in front of the teacher and that teacher had no idea it was going on. It would be the school getting in trouble and not the kids.

The school has a right to ask that children not speak spanish if those responsible for their actions (the school) does not speak spanish. Simple as that.

The government discriminates against non-english speakers all the time. In order to work in an FDA regualted industry you must understand all documented procedures. most of those are in English, including the document that that rule is written in.

Which is NOT the same as saying you cannot speak your native language in a private conversation!

That's ****ed up. We have several full-time employees in my office who are bilingual, but when they speak to each other, appear to prefer Spanish. Nobody seems to think this is a problem...

You have one wierd notion of freedom of speech. Unless the government has a compelling government interest and the law or policy is narrowly tailored to achieve that interest, YES, freedom of speech protects WHAT YOU SAY (it's call viewpoint neutral laws).

Bull... that doesn't mean they have to right to prevent kids from speaking Spanish in a private conversation. What is the government's reason? Because they may be talking about blowing up the school?! What BS! a law prohibiting all private conversations in other languages is far, far, far from being narrowly tailored.

Do you think the city has translators everywhere, who can keep an ear on all Spanish speakers to make sure they aren't talking about blowing up a building? Do we want that?

As early as Jr. High I had foreign language classes in the curriculum, nowadays they have it as early as second grade. If security were the real issue, the teacher ought to learn a few Spanish words.
