      I know the Bush administration is corrupt, incompetent, and not overly intelligent

      but they have to realise that allowing her to even get to the hearings will be such a failure on their part that they have to avoid it.

          Bush won't withdraw the name. His philosophy of leadership is to make a decision and then stick to it against all opposition. When has he ever publically backed off a position?

            I find that conspiracy theory laughable. Bush isn't using Miers, rather he feels that Miers is the best choice for the supreme court.

            I'm very disappointed in his decision over other more outspoken conservatives, and I saw a very good article asking the pertinent question if this is what we want to say to our conservative supporters, that the only way you will ever reach the Supreme court is to keep your mouth shut.

                  The Miers debacle grows:

                  Supreme Court nominee Harriet Miers collected more than 10 times the market value for a small slice of family-owned land in a large Superfund pollution cleanup site in Dallas where the state wanted to build a highway off-ramp.

                  The windfall came after a judge who received thousands of dollars in campaign contributions from Miers' law firm appointed a close professional associate of Miers and an outspoken property-rights activist to the three-person panel that determined how much the state should pay.

                  The resulting six-figure payout to the Miers family in 2000 was despite the state's objections to the "excessive" amount and to the process used to set the price. The panel recommended paying nearly $5 a square foot for land that was valued at less than 30 cents a square foot.

                  Mediation efforts in 2003 reduced the award from $106,915 to $80,915, but Miers, who controls the family's interest in the land, hasn't reimbursed the state for the $26,000 difference, even after Bush appointed her to the Supreme Court.
                  Which follows her embarrassing display of a distinct lack of knowledge of the constitution:



                  several constitutional law scholars said they were surprised and puzzled by Miers's response to the committee's request for information on cases she has handled dealing with constitutional issues. In describing one matter on the Dallas City Council, Miers referred to "the proportional representation requirement of the Equal Protection Clause" as it relates to the Voting Rights Act.

                  "There is no proportional representation requirement in the Equal Protection Clause," said Cass R. Sunstein, a constitutional law professor at the University of Chicago. He and several other scholars said it appeared that Miers was confusing proportional representation -- which typically deals with ethnic groups having members on elected bodies -- with the one-man, one-vote Supreme Court ruling that requires, for example, legislative districts to have equal populations.
                  And the White House is apparently already looking for ways to do a tactful pullout:

                    I think it's unlikely she'll be confirmed. If I was a liberal conspiracy theorist I'd think she had been nominated just to draw the heat for the next 'real' candidate.
                    I think most liberals just agree that Bush is a moron. There aren't really any "conspiracy theories" no matter how bad you want them to be there.

                        The Washington Times even named names in the White House (Sara Taylor) that were inquiring as to how to get out of the Miers nomination. Luckily for Ms. Taylor nobody reads the Washington Times, so her job should be safe for now.

                              It keeps getting better: now she's got her own mini-Whitewater to contend with:

                              Knight Ridder Newspapers reported Saturday that Texas officials paid Miers' family more than $100,000 for a small piece of land in 2000 — 10 times the land's worth — despite the state's objections to the way the price was determined. The land in question was part of a parcel in west Dallas owned by Miers' mother, Sally, that the state needed to build a highway off-ramp.

                              The three-member committee that determined the price included two women who were appointed by a state judge who had received at least $5,000 in campaign contributions from Miers' law firm. The price was later reduced from $106,915 to $80,915, but Miers has yet to return the $26,000 difference to the state.

                              White House officials said Miers was not involved in the donations to the judge and that the $26,000 is being held in an account in her mother's name.

                              "The repayment funds will be released when the settlement papers are finalized," Parell said. She said the issue was "a straight forward condemnation matter."
