      It sounds screwed up.

      To dump the rape charge would mean they would have to find consent--- I'm assuming here that the Swedish "sex abuse" charge is something akin to what we would call statutory rape (but with low penalties?).

      What is the stat rape age in Sweden anyway? In Canada its 14 IIRC and I think the US varies state by state from 12 to maybe 18.

      The decision does sound messed up and perhaps it is but lots of times there are facts that aren't part of the sensational story. I do have a tough time imagining what those could be though--- had she expressed consent explicitly before she had her first drink? While I don't believe any 13 year old should be able to legally consent, if the stat rape age in Sweden is 13 or less, there would be no sexual crime in that instance.

      It would be ironic if it would be illegal to give her booze but not to boink her if she requested both. To me, the law SHOULD be such that it would be a no-brainer that the older guys would be guilty of rape with stiff penalties regardless of her consent. The 16 year old . . it would depend on the circumstances, since stat rape often doesn't apply to people close in age.

      Bottom line is that either the court messed up in their decision OR Swedish law around this type of activity is inadequate

        Every time there's a controversial rape case in sweden where this happens there's a lot of huffing and puffing and absolutely nothing happens. This is far from the only case - court cases with incapacitated girls or girls "not protesting enough" have happened before, and been brought up in the media before... The promised law never appears to materialise.

        It's kinda like Utlänningsnämnden. When did the Riksdag vote for that one to be replaced by a proper court system again?

          hmm in canada the Young offenders ACT meant that no one under the age of 12 )IIRC) could be charged with a criminal offense. Drug dealers used to use these children since there was nothing the authorities could do. But I think there was anamendment to lower the age since children could literally get away with murder

            Sweden's age of consent is 15. But I don't believe the victim's age made a difference in this case.

              I know. But one'd think that sooner or later one proposal would get thru by quantum tunneling or something.

              Of course, the one to do it would be the one to label all sex involving women as "rape" unless she gave explicit verbal consent, with the burden of proof on the other party.

                      That is understandable, but from the law perspective a thief who just go through an open door to steal something is just as much a thief as one who breaks through the window on 2nd floor to get in

                              90% of rapes don't get to court and of the ones that do there is a very low conviction rate.

                                I think the prosecutor has not been innovative enough in finding multiple charges to push. Apart from the rape accusation, which is harder to prove, some obvious crimes have been commited:

                                - Alcohol peddling to minors
                                - Sex with minors (if she wanted it or not doesn't matter)
                                - The two above combined should make it easy to prove at least sexual abuse
