Well I know sometimes airports aren't considered national soil for all purposes (i.e. you don't need a visa to change planes.) Maybe there is a loophole there that they are exploiting.

I'm pretty sure that all parts of US airports are considered to be on US soil as far as jurisdiction for police and applicability of constitutional law is concerned. what should be noted is that this man was given a visa in order to travel. he was arrested the moment he got off the plane from Athens. surely you dont think someone with connections to terrorism got a visa to the US by accident....
