  • 2. Who is born a United States citizen?

    Generally, people are born U.S. citizens if they are born in the United States or if they are born to U.S. citizens:

    (1) By being born in the United States

    If you were born in the United States (including, in most cases, Puerto Rico, Guam, and the U.S. Virgin Islands), you are an American citizen at birth (unless you were born to a foreign diplomat). Your birth certificate is proof of your citizenship.

    (2) Through birth abroad to TWO United States citizens

    In most cases, you are a U.S. citizen if ALL of the following are true:

    Both your parents were U.S. citizens when you were born; and

    At least one of your parents lived in the United States at some point in their life.

    Your record of birth abroad, if registered with a U.S. consulate or embassy, is proof of your citizenship. You may also apply for a passport to have your citizenship recognized. If you need additional proof of your citizenship, you may file a Form N-600, "Application for Certificate of Citizenship" with INS to get a Certificate of Citizenship.

    (3) Through birth abroad to ONE United States citizen

    In most cases, you are a U.S. citizen if ALL of the following are true:

    One of your parents was a U.S. citizen when you were born;

    Your citizen parent lived at least 5 years in the United States before you were born; and

    At least 2 of these 5 years in the United States were after your citizen parent's 14th birthday*.

    • no no no u guys are making it more complcated than it is.

      If ur born in US soil ur US citizen. If ur not born on US soil then ur not.

      If ur abroad and gave birth, either you can give birth in an US soil near (if they have US embassy it counts) or I think you can do soem paperwork (like boris said).

      • Calc, the above was pasted from the official U.S. gov't web site. You do not have to be born on US soil to be a born a US citizen.

        EDIT: removed wrong use of naturalized.

            Still, you don't have to be born anywhere near U.S. soil. If both your parents are U.S. citizens, or one is and has met the requirements mentioned above, you're born a citizen and ergo elligible to be president.

            • not always boris, like u said u may have to do some paperworks...
              im not sure on details but the only sure way of being born US citizen is being born on what is considered US soil.

              key point being
              "In most cases, you are a U.S. citizen if ALL of the following are true"

              as in probably they will most likely grant you this if you file a form, but its not a always guarantee

              • That's only if ONE parent is a citizen.

                If BOTH are US citizens, you are born one, no matter where. So if a US couple vacationing in some remote island had their baby far from US soil, that baby is born a citizen.

                • i just got this from ur statement and am making arguement based on this:

                  This makes sense. Some two US citizen cant be living in germany actually with something like equivalent of green card and permeanant residency and have a child and expect the child to be natural born US citizen. Therefore the key being "most cases"
                  If BOTH are US citizens, you are born one, no matter where. So if a US couple vacationing in some remote island had their baby far from US soil, that baby is born a citizen.
                  Most likely theres no reason why govt wont consider this child a born US citizen. What Im arguing is the only 100% way to be sure the baby is US born citizen is being born in US soil. Doesnt mean you cant be one born outside...

                      In such a case, I bet they could expect it to be born a US citizen. US citizenship does not expire, after all. It doesn't even require them to have lived for any significant time in the US--just "at some time."

                      • Yes that means they may be eligible to have their offspring be citizen of US (or if germany also supports dual citizenship, citizen of both country)

                        They may is the key only sure 100% way still is being born on US soil.

                        • How far do the rules on embassies extend? Embassies are officially on the home nation's soil, right? So what happens if a baby is born in, say, the American Embassy in London?
