    A federal appeals court ruled Tuesday that rap artists should pay for every musical sample included in their work — even minor, unrecognizable snippets of music.
    The case centers on the NWA song "100 Miles and Runnin," which samples a three-note guitar riff from "Get Off Your Ass and Jam" by '70s funk-master George Clinton and Funkadelic.

    In the two-second sample, the guitar pitch has been lowered, and the copied piece was "looped" and extended to 16 beats. The sample appears five times in the new song.

    I'm not a particular fan of English rap, but it's indeed a ridiculous idea to charge for every lousy sample.

          Maybe rap will become something more than rhyming to other peoples music.

          This has been the thing that annoys me the most about rap music.

          All started with Vanilla Ice ripping off Under Pressure.

              There's not often any 'new' music. Most songs are ripped from other artist, and modified a bit to your own taste, and with your own 'sound', but it's the same thing. You rely on other music to make your own.

                    technically it started with Run DMC ripping off Aerosmiths' walk this way. But they included Aerosmith in the video and it restarted Aerosmith's career- so they aren't complaining.

                      Influence is one thing... actually using it is a different story. The question as I see it would be... did they need the actual recording to create their own final work... and if the answer is yes... PAY UP. They are stealing somebody elses work.

                          It's not "ripping off" if they have the cooperation of the owner of the music.

                          I didn't see Freddie Mercury or even David Bowie in the Vanilla Ice video.

                            Er... Technically it started with Kool Herc in the mid-seventies, or if you want to be arcane about it Count Machuki in the mid-sixties. (Recorded: U-roy, 1969/70 (Jamaica), probably Grandmaster Flash,1980/81 (US).)

                            Sampling, versioning, whatever you want to call it, is one of the premier creative devices of this century because it breaks off the ridiculous victorian "single creative genius" mythos and allows people to improve on music without ridiculous "ownership" restriants.
