NO, Hamas has no problem taking over Gaza. BUt any moderate Palestinian would have to be nuts to take over Gaza in its current situation, specially if Israel will maintain control of all access.
Sharon keeps these assasinations going to 'prove' to Likudniks that Hamas will be too weak to take control. Perhaps, but then, why should Hamas be the only organization of radical Palestinians in existance? New groups are free to sprout up.

So you would let a failed assassin go free, and jail a person who did something by accident?

But as to your question (even though it may lead to a threadjack), I think the actual outcome is to be weighted when judging. It is obvious to me a failed assassin can't get a full penalty for what he evenetually didn't do, and an accidental killer should suffer at least some consequences of that kill.
But again, I'm armchair-generaling behind my computer, in the comfort and saftey of my midle-class French home. If I lost my gf in a "colateral damage", I would be much, much less patient toward the killers, accidental or not.

NO, I don;t. BUt of course, I am not the one trying to implement a half plan on the ground. Israel can't claim to have left Gaza and still control access. Of course, whomever was going to gain political control of Gaza should take those over-too bad Sharon didn;t say anything about that part....

What everyone is forgetting is that Hamas sent in terrorists to blow up a chemical facility in Ashdod a few weeks ago. Had it succeeded, wed be talking thousands of dead Israelis. As far as Israel is concerned Hamas has already taken the gloves off, and is doing everything they can anyway. Israel wont tolerate this, and will do whatever is necessary to destroy Hamas.

Bzzzt. wrong. Hamas can't take over Gaza. Hamas is outnumbered by the Fatah, and PA ( which would 'miraculously' join forces, if hamas attempts this )

- they'll lack experience of organization, completely.
- they won't have the manufacturing facilities, or experience.
