        Bush's fundie base has ben gumbling quite a bit about him. He needed to throw them this bone.

                          So much for any semblance of Bush believing in federalism and so-called states' rights. I guess a state cannot choose to have activist judges or gay marriage. After all, those "activist" judges were state judges passing on state law. Since when have conservatives (well, those with any intellectual honesty) thought it was the job of federal officials to deal with putative "activist" state judges.

                          Bush might want to consider his legacy at this point. He's now going into the history books as yet another official blocking the door to the schoolhouse.
