The same could apply here possibly but as I said there won't be a problem probably. Everything that could increase sales instead of decreasing them, nomatter if it would violate copyright and trademarks should not rise legal actions. But we should be aware that using the name "Call To Power" and any graphic, modified or unmodified from the original CD could be subject to copyright issues.

It specifically says trademarks, copyright-protected of third parties, so distributing Activisions should be OK.
In the first paragraph the EULA specifies what should be bound to the EULA:

IMPORTANT - READ CAREFULLY: USE OF THE CALL TO POWER II SOURCE CODE IS SUBJECT TO THE SOURCE CODE SOFTWARE END USER LICENSE AGREEMENT TERMS SET FORTH BELOW. “CALL TO POWER II SOURCE CODE” INCLUDES THE SOFTWARE INCLUDED WITH THIS AGREEMENT, THE ASSOCIATED MEDIA, ANY PRINTED MATERIALS, AND ANY ON-LINE OR ELECTRONIC DOCUMENTATION, AND ANY AND ALL COPIES OF SUCH SOFTWARE AND MATERIALS. BY INSTALLING, AND/OR USING THE CALL TO POWER II SOURCE CODE, YOU ACCEPT THE TERMS OF THIS LICENSE WITH ACTIVISION PUBLISHING, INC. (“ACTIVISION”).

There is no reference to the name of the game "Call To Power". Unless of cource the name is included in the printed materials and electronic documentation, and the graphics in the associated media.

They always do licence agreement so criptic

                  • Nice one, CoT

The entire idea behind releasing the source code was so that we could improve the existing game. That's obviously not possible if Activision were to sue us over reusing the current game's graphics or name or text files or whatever. So we really don't have to worry about things like that -- if Activision was out to screw us they wouldn't have released the code in the first place.

Although it's indeed good for us to be aware of any copyrights and trademarks involved in the products we create: not just Activision's but also think of all the graphics and stuff some of the mods ripped from other games -- we should be much more careful in doing that for the Source Code Project.

                        • I dont know - i think if we're taking content from other sources that might be protected by copyrights, it should not be included in part of the source code/Apolyton CTP2 release.

Keep it in the mods if need be - that way you'll only get one bunch of lawyers on your ass, and not Activisions too

Or if you like i could remake CTP2 from scratch with all origional content, of about the same quality as my title screen

Why would we need to steal copyrighted/trademarked graphics/other content from other games/sources? Even in mods/scenarios. Doing so only invites the owner of the content to sue us individually, this site and its owners for distributing the material illegally, and Activision for allowing the content to be included in their product. Activision is then likely to sue us and Apolyton for failing to comply with the EULA and for doing all of those things that the EULA says we cannot do, but Activision said they would ignore.

                            • True - there's enough of us with Photoshop etc to make new graphics where needed. I dont like the idea of nicking other people's work either - still if it came with CTP2 it should be ok under the agreement to modify it, as long as it will always need the origional CD to play from.
