    Trump (or like-minded successor) would need to fill RBG's (83) and Stephen Breyer's (78) seats, which isn't that big a stretch. Overturning Obergfell v Hodges, or otherwise deciding horrible things in cases involving homosexual rights, would require just one of those seats.

      First, I don't think Trump is even against gay rights. You're making too much of a list of potentials . It's likely that he doesn't even know how to select a nominee. Other people suggested names to go on that list. That doesn't mean that he is going to select the most offensive pick to homosexuals.

      Second, you don't seem to have the least amount of confidence in SCOTUS. It would take 5 votes. You're telling me that you are actually scared that 5 justices would vote for that?

        Also, there are 21 potentials on that list. You're talking about one of them. The chance that he will be nominated and confirmed are less than 1 in 100.

              In 2003, Thomas, Rheinquest, and Scalia voted for it. Thomas is still on SCOTUS. That's one definite one. Rhenquest was replaced by Bush's pick Roberts, who wrote the dissent in Obergfell v Hodges. So that's probably 2. Trump has praised Scalia to no end, has promised to pick a similar justice to Scalia, and proposed a list of potential nominees which are almost all (if not all) anti-gay. So his replacement for Scalia would be 3. RBG and Breyer are both getting up there in age. If Trump nominates 2 more like Scalia, it's a very real possibility.

              SCOTUS can do horrible things, and has. It can do great things, and has. My confidence in it depends on who is on the court and what decisions they make.

                I doubt if Trump even understands Scalia's beliefs. That's called campaigning. I don't think he hates gay people either. I think there is a small chance that Pryor will be elected but not because Trump wants to put gays in jail. So not likely that gays will be put in jail.

                  It doesn't matter why Trump nominates them, once they are on the court they make the decision. The President has no say in court decisions.

                    If Trump doesn't want gays to be thrown in jail there's basically no chance that that is going to happen, yet you are going on as though it were a real possibility. This is what gets my goat, and if I tell liberals that they act like I'm homophobic. I'm not homophobic because I don't buy into your scare tactic.
