    The Logan Act has never been the basis for any prosecution and I'm skeptical that anyone would ever be successfully convicted on it, least of all a senator or governor.

      It's part of the United States Code. If you think it shouldn't be there, lobby to have it removed or challenge it in the Supreme Court. Until that time it's law.

      This right here is the exact problem. Apparently those who enact laws think they don't have to abide by them. If that doesn't make you angry, then you don't deserve to live in a democracy.

          To be fair if it were going to used against a Senator, it would have been used against Ted Kennedy for his attempts to for an electoral alliance with Yuri Andropov against Ronald Reagan in 1984 or Jim Wright for the ‘Dear Comandante’ letter.

            Also Nixon for sabotaging the Vietnam peace talks. This just means that the law hasn't applied to those in higher office for a very long time, if ever.

              I don't think anybody here would call me an Obama supporter.

              I believe that Iran is behind a large percentage of terrorism in the world.

              I believe that people are idiots if they don't think Iran has designs on getting nuclear weapons.

              All that being said...I think the Senators were wrong to do this. They have more constitutional power than anybody else in the country to thwart any treaty that they do not like, but it is the President's job to negotiate them. Obama is the President by two popular elections. Disagree...fine. Vote against the treaty if you don't like it...fine. Undermine the credibility of the U.S. President's Office to conduct foriegn negotiations...NOT fine. Very bad precedent set here.....

                I don't think he's actually intending to put the Iran deal up for a Senate ratification vote based on the reporting I've seen.

                    Then arrest them and challenge it. It won't happen, because it will be declared unconstitutional.

                      If you were ever going to see a Congressmen charged under the Logan Act, it would have started a long time ago because this sort of action is hardly unprecedented.

                              Yes it is illegal. Whether that law could stand up to a constitutional challenge is irrelevant. Its an illegal act in the USC.

                                No it's not irrelevant. If a law is unconstitutional then violating it is not illegal.

                                In any case, the horse got out of the barn decades ago so getting upset about some senators violating this very dubious law is silly.
