I'm more curious about the basis for the differing legal theories behind the two actions. If the State pursued and received a conviction of statutory rape due to its in ability to recognize the legitimacy of any consent a minor might give in this situation, under what basis does it then turn around and pursue someone the State argued was a victim because they've now decided that he can give consent?
