I never said he was innocent, but I'm damned if locking him up indefinitely and torturing him to extract a confession is the sign of a justice system thats working.

Telling him big black guys raped someone in the shower is a form of torture now?

          No. The enemy fired first.

Should we count this stuff instead?

But you want him to be treated as a POW?

Yes of course, or else if you want to treat him as a non-combatant then do so within the normal legal system, not this farce of a kangaroo court.

Nothing new about it. People have been shot on site at the side of the road for not being in uniform for centuries. It is a long extant rule of war.

That basically is the case. If a uniformed police officer kills someone in the line of duty it is unlikely to be murder. If anyone kills a uniformed police officer it is very unlikely not to be murder.

I would attempt an intellectual discussion with you Kid about the actual facts of the case but quite frankly in such a discussion I would have to consider you unarmed. Geneva prohibits it.

It's a bit more difficult to try and claim rules of uniformed combat when you're invading a country to fight a non-uniformed opponent.

                        • No. It is not. You might say the lawless nature of the place was a factor in the invasion to begin with.

That doesn't mean the rules of war get tossed in the trash bin.

                          • Sorry but if you invade a country to fight a non-uniformed opponent, you can't really sit and cry about how the people you're shooting are actually shooting back at you. It's also a bit rich to claim they are not real soldiers and therefore don't deserve any of the protections of war.

                            • Nobody is saying they did not deserve the protections of the rules of war. They did indeed get them. People who took up arms in an unlawful manner were prosecuted, not shot at the side of the road.

                              • they weren't prosecuted, they were taken and held without trial for years, or sent to third countries where they often suffered torture.
