Being gay, wanting to smoke pot, wanting to mess with kids, enjoying Civilization, whatever, these are all internal states of mind. They are a result of how our brains are wired. Nobody chooses to be a pedophile, it's a mental illness. Nobody chooses to enjoy Civilization, it's a matter of taste. Some people can't stand slow computer games, some people think pot is boring, some people prefer ***** to dicks. None of them are making a choice in their preferences, that's just how their brains are wired. The choice is whether you sit down and start playing Civ, or smoking weed, or ****ing a dude. The action is the choice, the preference is out of our control.
So long as acting on that preference doesn't hurt anybody, it's unjust to make laws against it. Pedophilia is a crime because it harms children. Civilization might be bad for your grades, but that's not sufficient to warrant a limitation on liberty. Homosexuality poses health risks, in terms of HIV transmission, but that's not sufficient to make it criminal. In the same vein, pot has health risks, but they're not sufficient to warrant criminalization.
