All this blather about incapable of giving consent due to inebriation seems like a load of hogwash to me. Should we have breathalysers and an army of lawyers in the bedroom to give detailed legal advice before, during and after the proceedings? Can't change your mind afterwards. If it seemed like a good idea at the time, live with it.
If one chooses to get drunk then one is responsible for the consequences of ones own action when drunk. It does not magically transfer responsibility to "others".
The remedy for such a mistake is to chew ones own arm off in the morning to escape without waking "it" up.

I read this at the weekend.
A very large proportion of women don't want to press charges after they've been raped, and best evidence is that most never go reported. Why would a man be any different? And some of your reactions here show why, if anything, it'd be even less likely.
Even if the guy does have some gay/bi tendencies, that doesn't mean he deserves to be raped.
And the whole "how do you know what consent was given between two people in private" issue is why rape is so difficult to prove and convict.
If you met a girl at a pub, took her home with you, had a drink, talked about poetry and she fell asleep. You'd still be a rapist if you took advantage of her when she fell asleep! Whether she was into you or not.Jon Miller: MikeH speaks the truth

What is the burden of proof in rape. I assume it is that you have to proof beyond reasonable doubt that consent was not given?
I won't assume rape on his say so (if he filed charges, or had the article written by someone else with a reality filter it would be different), and his language is dressing up a story from what I can tell.One day Canada will rule the world, and then we'll all be sorry.

Willingness to press charges, or not, gives you no information on whether it's rape or not.
Most rape victims can't bear going through the accusation, trial process. Because a load of people immediately judge them. "She was asking for it" "He's just gay and can't admit it" etc.
I imagine part of his decision not to charge is that he knows the prosecution case is tiny, not to mention the added humiliation he'd feel.

mike makes some good points but this case gives me doubts. i mean the guy can't go through an accusation and trial process but he can bear his soul to a reporter.

If he is not reporting it because he is really gay/etc, then why is he talking to the reporter about it?
Maybe the issue is that he knows the law and knows that with how the law is currently that the crime could not be prosecuted.
And he is trying to change the hearts and minds of people (like many in this thread) who think this isn't wrong.
