Indeed. It's amazing. This was Libermann's and Collins' great achievement (on the breaking of the filibuster). Obama didn't do anything to push it through.

    • I think its actually better that congress has finally repealed this stupidity. I think it has more 'gravitas' compared to a presidential or court ordered decree.

      • Well I didn't mean a decree, but the President can throw his weight around and actually push things along. Witness Dubya.

Indeed. He could and should have complied with the court order until such time new regulations were passed, rather than instructing/allowing his justice department to fight it tooth and nail in court. In this fashion he would have been able to force the issue to a resolution and hold congress accountable all the while having the court decree provide his means of cover. In the meanwhile the military would have been living immediately without DADT unless and until overruled by some new legislation that could pass constitutional muster.

That's apparently some sort of controversial statement when I say it.

However, you're right. I should have simply responded with the fact that I saw no meaningful difference between Spencer's and the point I was making earlier about the reason Obama was pushing for Congressional action while trying to stave off a Court decree which you for some odd reason felt the need to take issue with.

In that case (which I didn't get at all due to your usual vagueness), court decrees take a LOT of time with appeals and all that. Laws can be done much quicker.

                          • Clearly not as this example shows. 2 years in which it could have been done and a court decision still came out before a repeal by Congress.

                            • A Circuit Court, not Supreme Court. Big difference.

There are loads of totally fabricated "rights" that the Supreme Court (and other federal courts) has just decided exist.
You're familiar with the 9th Amendment, right? This is one reason Madison argued against adding a bill of rights to the Constitution.
