Indeed. He could and should have complied with the court order until such time new regulations were passed, rather than instructing/allowing his justice department to fight it tooth and nail in court. In this fashion he would have been able to force the issue to a resolution and hold congress accountable all the while having the court decree provide his means of cover. In the meanwhile the military would have been living immediately without DADT unless and until overruled by some new legislation that could pass constitutional muster.

However, you're right. In that case (which I didn't get at all due to your usual vagueness), court decrees take a LOT of time with appeals and all that. Laws can be done much quicker.
