      • Well in the gay marriage debate SCOTUS can just use Loving v. Virginia which seems to fit very nicely.

              • It is an issue that will lead up to marriage rights. After all, gays serving openly in the military was something around 3/4ths of Americans approved. Next step is marriage.

                      • Because Obama is a relatively spineless President who wants to let Congress do things rather than use his bully pulpit (see Health Care Reform)?

                        As miscegenation and other civil rights legislation show that Court action to defend equal rights of minorities does not usually lead to polarization in the democratic arena. Conservatives really only have the talking point about abortion.

                            • Where is abortion mentioned in the constitution? For that matter, the right to privacy? Or the right for gays to marry or ANYONE to marry?

                              There are loads of totally fabricated "rights" that the Supreme Court (and other federal courts) has just decided exist.
                              If there is no sound in space, how come you can hear the lasers?
