    • I've now spoken to my dad about this, who says that based on discussions with other lawyers in his law firm that Wiglaf is actually right. Now I recognize the "MY DAD SAID SO" argument is one of the weakest on the internet, so I'm not actually trying to convince you all of anything, since for instance a Canadian software engineer's opinion on American copyright law means nothing, but the facts that Wiglaf have presented align with facts I have already seen, and this consistency is compelling to me.

More to the point, it's also applied uniformly. For it to be true censorship they would have to apply the law inconsistently.

Why don't you read the ****ing law instead of appealing to authority (your dad, your idol in Wiglaf)?

I'm starting to suspect you have a complex.

PS: I'm fairly certain your dad is not a copyright lawyer.

Because my dad is actually a practicing attorney and has no reason to lie to me? What a stupid question.

Oh boy, I'll just try to interpret a complex law without any legal education as opposed to pose the question to the relative expert who lives in the same house. Jesus christ.

Who cares if he's a practicing attorney if this is not his field?

It's not that he lied to you, it's that he's probably as blissfully ignorant of the specifics of the law as 99% of Americans seem to be.

              • Why don't you ask him about why the courts ruled Real Networks cannot make software to facilitate people making their own personal backups, if such a thing is so obviously legal?

He's a lawyer, so I assume he's intimately familiar with the specifics of this case, as he's apparently a leading expert in the DMCA.

                • Asher, I'm not going to try to justify my trust in my father to you, it makes no difference to me whether you think my trust in him is valid or not. What a waste of time.

This thread doesn't have anything to do with your daddy issues.

I'm asking you to reason this out.

                    1) Read the law
                    2) Explain how it mentions there is an exemption for personal fair use backups, if it's not there in writing...
                    3) Explain how the court ruling being cited as precedent for allowing personal fair use backups used the word "may", while simultaneously ruling it illegal for a company to make software to facilitate making personal fair use backups (backups that are, themselves, protected by DRM to prevent distribution)

I'm going to save everyone time and state the obvious. The reason why you and Wiglaf have not been able to do this is because I'm right.

So you can't defend your argument?

Others in the thread already have, and I'm explaining to Asher why his interpretations of the evidence are not as compelling to me as for instance Wiglaf's.

                          No one has.

You and Wiglaf either point to daddy or point to a ruling which is not definitive and itself makes it illegal to make products to produce fair-use personal backups.

That does not constitute a defense, especially when you both refuse to respond to my challenges about the specifics.

                          • Considering that this is the same Asher that needed 7 pages of repetition to make him realize that he isn't a helicopter pilot for the Army and doesn't know **** about friendly fire, I can trust that by page 6 all arguments have been made and I can't be bothered to walk over covered ground myself.

                            • Also, answer me this: why did the US congress not add an exemption in the law for personal, fair-use backups when given the opportunity in July if they intend for this to be legal?

Am I the only one here with a functioning brain?

                              Are you serious?

Your attempts to avoid answering questions you know would submarine your argument is as obvious as your virginity.

It's interesting that you simultaneously recognize that the argument you're making is "one of the weakest on the internet" and insist that it's "compelling".
