smokers should be considerate (and most are), but there's a limit to how considerate you can be. if someone is smoking in their own home or on an open air balcony, then there's not much more they can do to prevent others being affected by their smoke.

as a non-smoker who's lived with smokers for all of my adult life i would advise you to be around smoke enough so that it doesn't bother you any more. it's not that big a deal, really. you're probably doing yourself far more damage getting stressed about the smoke, than the smoke itself is doing to you.

Seriously, in my 4 walls, i smoke whatever i want to smoke, whenever i want to smoke. I do see, that smoking (cigs at least) is kinda dumb and that it will hopefully be as antique and grotesque soon as slavery seems to us today. But the non-smokers might want to take into consideration, through what great length smokers were forced during the recent years already. I´m talking price-increases, bans and ´stigmatisation´ (this word is too much, but you know what i mean). When i started to smoke, the Marlboro man was still telling me so, from many a wall and many a magazine. It was rediculous to go to a bar if you were offended by smoke. In every movie, the hero smoked (or at least he could have). And today, you shouldnt be allowed to smoke on your own balcony?!

I also think, that some people are really panicking about the smoke a tad too much. Gosh, when i was a kid, my rents were smoking all the time - in the car! Now, that was a bit too much and they reduced it, after my bro and i complained. But basically, that was nothing unusual. Today´s rents freak out, if you didnt wash your hands after having had a smoke (far away of course - must be out of seight, as well) and return to playing with their kids. If there had been a century in between - fine. But i am talking two decades here. Non-smokers really cant complain about people not caring. They achieved more in two decades than the afro-americans in two centuries - kinda (overstating again, but again, you would get the idea).

So, yeah, ban cigs. Make them avaiable at the doctors only. They should take blood samples (or somesuch), so to proove, i am not a starter and then sell them to me for the usual price. This way, no one will start to smoke anymore, the taxes still come in from those who do smoke, and smoking will die out with the smokers. But as long as there are smokers they and their addiction should be met with some level of tolerance at least.

But it's quite another if your gay neighbour had sex in public or had sex constantly and VERY LOUDLY such that it disturbed you every single night for most of the night. You can only ask for so much tolerance...

EDIT: But your problem is rather technical, asher, i´d say. If the ventilation sucks so badly, your landlord needs to fix it. Actually, since there is nothing in the conract saying people were not allowed to smoke in their appartments, he´d be obliged to fix the vents, in order to protect the non-smokers. On this basis, tenants would probably be able to sue him to fix it here.
