Saying 'I don't have my license I left it at home' is like saying 'I've got warrants for rape please just give me a ticket.' These people should be incarcerated and then a judge can release them if there's not enough space.

As Donegeal already pointed out (and you ignored) they will be arrested if they have no other ID."I have never killed a man, but I have read many obituaries with great pleasure." - Clarence Darrow

I did read the whole story. No where did it say that she was unable to produce a valid ID.
This is a clear problem because she gave a false name. THIS IS WHY YOU ARREST PEOPLE WITH NO LICENSE OR A SUSPENDED LICENSE.
And the cop is susposed to just instantly know that its a false name and ID. I suspose so, becuase cops are supermen.
If they are not qualified to drive and/orcannot definitively ID themselves, they go to jail.
Corrected.
I have no idea where you are a cop
Walworth County Wisconsin. I have said so before, and even used my county patch as an avatar for about 6 months.
-- perhaps they do it this way in the boonies, but in the real world, driving without a license/suspended license is punishable by about a month in jail and a suspended license for a year.
Correct; that is a common sentence. However, this is not a matter of sentence, it is a matter of arrest.
It is when cops make dumb judgments like this one in the story (and like you apparently do all the time) that crap like this happens.
For your information, I do not just let people go when they were driving without a valid DL. My department has a policy that requires everyone issued a traffic citation of this type to be arrested and booked into jail.Founder of The Glory of War, CHAMPIONS OF APOLYTON!!!

Er, this contradicts what you say earlier in the post:For your information, I do not just let people go when they were driving without a valid DL. My department has a policy that requires everyone issued a traffic citation of this type to be arrested and booked into jail.
That policy is correct. What you've been saying, and what the cop did in the OP is wrong. If they are not qualified to drive and/or cannot definitively ID themselves, they go to jail.
Corrected.
As he points out himself in his last post, they should be arrested if no license, regardless of whether they can produce a college ID or registration or whatever. Because they are more likely to be bogus, slow down the process, encourage people to drive without being qualified, etc.Originally posted by Wezil

Wiglaf... this is a department policy, to a strict rule for everyone everywhere.
And I'm not contradicting myself. I am saying that they don't need to be arrested if they have a form of valid ID, just that my department wants them booked in regardless.Founder of The Glory of War, CHAMPIONS OF APOLYTON!!!

In 2006, Oakland, Ca. had a Drunk Driving sting in Oakland. After the sting started, they were stopping cars with driver that did not have a valid driver licence, or insurance. After awhile they had so many cars, they did not know what to do, so they call downtown for instruction. Pat Brown was the Mayor at the time, and he instruction the police to let all of the unlicence drive go with their cars. However someone in the PD call the press and told them what happen and of course the press call Brown. He told the press it was not the job of his PD to fine out if the driver were illegal or not. The PD did stop a number of Drunk Drive that night and they were arrested.Originally posted by Arrian
Question (serious one):
If a person is pulled over and lacks a valid license, what happens? They get a ticket, right? Anything else? Is there followup? Is proving citizenship part of it? Does it even come into play?
What I'm getting at is whether or not the cop who cited her for driving w/o a license in 2006 really "failed to do his job." I'm not sure that's the case.

Since she wasn't driving, there was no need for her to have either. It is not against the law to be without an ID card. If she had been driving, that would have been a different story... but as a passenger, she was irrelevent to the situation with her boyfriend.Originally posted by DinoDoc

I can understand not booking someone for driving without a liscense, but the women "plowed into someone's yard." I would think the officer would take that into consideration and go ahead and book her. However, people need to understand that police have other things to do sometimes, and they need to set their priorities.I drank beer. I like beer. I still like beer. ... Do you like beer Senator?
