          It is, but this is a theoretical point, and - all possible considerations about the character of intl law aside - praxis is "we" did get away with it. That is not meant to sound triumphant, because yes, there's the danger of further erroding intl law. I don't deny that this could be a problem, but I see also problems when the UN constantly fails to act according to its own principles, and when it often can't provide anything in real help to solve intl problems, which was actually one of the main tasks of the UN originally. The question is then, should nobody ever do something if the UN and its various members are deadlocked and can't get their **** together. My answer would be not to wait for the UN then. But I can certainly accept if others have other answers....

          And Bavaria of course doesn't get any independance evar

            The Merkel administration announced that they will recognize Kosovo on Wednesday. Doesn't really surprise that one Mafia family recognizes the other.

                    NY Times reports that the US has joined Great Britain and France in officially recognizing Kosovo as an independent state and will establish formal diplomatic relations. Germany is also reported to be doing so.

                    Predictably, Serbia has withdrawn its ambassador from the US in protest.

                    Spain has declared it will not recognize Kosovo. Russia failed in its attempt to get the UN Security Council to proclaim Kosovo's independence null and void.

                            Wasn't it the policy of the US to call for the creation of a Palestinian state, for example in the so called road map? Maybe the fact that there's terrorism does not generally invalidate the drive for independance in certain conflicts....

                              That's far from being funny, by the way. Unilateral behavior like this is the reason why the UN has become pretty much useless, if it ever had any use at all. The logical consequence should be to have the honesty to disband it. Of course since most countries, especially western, are run by idiots and lobbyists, this won't happen.
