It is, but this is a theoretical point, and - all possible considerations about the character of intl law aside - praxis is "we" did get away with it. That is not meant to sound triumphant, because yes, there's the danger of further erroding intl law. I don't deny that this could be a problem, but I see also problems when the UN constantly fails to act according to its own principles, and when it often can't provide anything in real help to solve intl problems, which was actually one of the main tasks of the UN originally. The question is then, should nobody ever do something if the UN and its various members are deadlocked and can't get their **** together. My answer would be not to wait for the UN then. Too bad, the UNSC did not approve it, that makes it illegal. We can't accept UNSC decisions only if they fit our agenda. Even though it may be reasonable (I grant you that), illegal is illegal.

NY Times reports that the US has joined Great Britain and France in officially recognizing Kosovo as an independent state and will establish formal diplomatic relations. Germany is also reported to be doing so.
Predictably, Serbia has withdrawn its ambassador from the US in protest.
Spain has declared it will not recognize Kosovo. Russia failed in its attempt to get the UN Security Council to proclaim Kosovo's independence null and void.

That's far from being funny, by the way. Unilateral behavior like this is the reason why the UN has become pretty much useless, if it ever had any use at all. The logical consequence should be to have the honesty to disband it. Of course since most countries, especially western, are run by idiots and lobbyists, this won't happen.Comment
