It may be a matter of semantics, different in two languages. In mine you can't steal (as in "theft") anything that is not substantial, i.e. a service.

You can "stehlen" (steal) a thing.

You can "erschleichen" (obtain by fraud) a service.

It is probably a language issue. Fraud would be the more correct of the two but the definition of theft is pretty wide.

On a more serious note, I think it's BS. I mean BS from the guy's part. How do you go for a prossie and not pay? How cheap is that? It's like some guys who would know the price and then later on try to get a cheaper deal. You got the service, you pay, it's really that simple especially in the prostituion game. It's the last place you should be cheating

For the purpose of the question, discount the weapon. The weapon, although only a pocket-knife, imo, definitely makes it rape.

There can't be any theft, since it's an illegal activity. You don't have any legal right or title to proceeds from an illegal activity.

Displaying and threatening to use a weapon is pretty open and shut on the rape side. There's not much arguing consent when you threaten to cut someone up or shoot them.

Ok, not an attorney here, but currently in North Carolina, taxes are levied against illegal narcotics trafficking, speaking of the product itself, the courts have ruled sales tax is indeed collectedable.

I remember one instance a doper walked into the tax office and declared he had "X" hundred pounds of marijuana. Of course, he was allowed to pay the fine and then a "Tax Collector" had to verify this, which was of course an undercover narcotics officer.

So, my point is even though it is illegal one can still be held accountable for taxes.

I would believe it is similiar to a person selling a peanut, a piece of soap or something similiar in representation of a real piece of rock cocaine. Even though it is not, it is still against the law to try to sell it as such.


Im sure Donegeal can attest to how Wisconsin treats such activities, maybe in a similiar fashion.

Yes, look back in history and see that many mafia or gang members are taken down for tax evasion on illegal activities and not those illegal activities.

And I think if I break into someone's house and steal illegal drugs, it's still considered theft.

In a few, not even the majority, of the encounters he would display a pocket-knife.

For the purposes of the discussion, the weapon has to be discounted, at least in those instances where it was used. Otherwise it is simply rape, no question.

Arguable either way. In jurisdictions where there's a "breaking and entry" statute, you're definitely liable for that. In jurisdictions where there's a "trespass on property" statute, you're liable for that too. Those are non-goal-specific, meaning it doesn't matter what your final intent was - merely doing certain acts is enough to land you outside of the law.

In your hypothetical, the homeowner would likely have a valid case against you for both trespass and B&E. If they were so foolish as to bring a suit against you for theft, they may or may not prevail on that, but the state would likely sua sponte bring a case against both you and the homeowner for illegal possession.
