That has happened. One with some illegal drugs called the police because some other guy had stolen some of it. The one calling the police was taken because he had drugs and IIRC the other guy was taken both because of the drugs and because he stole it

NO-- I think that parties tend not to involve police much in their dealings-- Although there is no law against the prostitution itself, you and I are both aware that there are a number of laws around the byproducts or ancillary parts of prostitution such that people don't want legal scrutiny

So in that case, if he doesn't pay up front and proceeds to do the act, he's raping her. So if you look at it from the paying up front perspective, it's rape.
paying after seems more shaky on principle. She is agreeing to it. Just like a woman technically shouldn't be able to change her mind after a normal encounter and cry rape (though they often do once they wake up in the morning ); so a prostitute shouldn't be able to change her mind about agreeing to sex. It would be more like robbery.
So the paying up front scenario is rape, the paying after is robbery. Although it shouldn't make a difference.
