Legally, I don't think it is rape or theft. As was pointed out, she consented to have sex (no rape), but the contract was criminal so cannot be enforced (no theft).

It's obviously not rape, as the intercourse was consensual. Neither is it theft. Theft is taking away something (an object or money). That is not the same as not giving something. The prostitute and the john made a service contract, that it's only verbally doesn't matter. She delivered her part, he received it but did not deliver his.

Maybe she could argue that she was giving you sex as well, and thus the sex was a mutual consideration (sacrifice of a legal right) as well as a mutual benefit (gaining of a legal right).
Thus, you're going to have to do more to get those sweet, sweet cookies and those clean, clean dishes.
