    I do buy that argument, btw. It's perfectly reasonable, IMO.

    Don't like it? Think it's unfair, or worried about false accusations? Don't buy (or pretend you're going to buy) sex.

              I think that nonconsentual sex is significantly worse than simply not paying for a prostitute. Consider the probability of physical and psychological trauma for the two cases.

                            Yes, many prostitutes work nonconensually, and those could certainly be considered rape, but a woman can give consent to sex for reasons other then currently wanting sex.

                              It depends on what the local jurisdiction's definition of rape is.

                              From what I understand, a majority of U.S. jurisdictions state that rape is penetration, including per os or anum, against the woman's will. Emission is not required. Some jurisdictions require a showing of force, or the reasonable fear of force. (One extreme is Maryland, which requires the woman to show actual physical struggle, or failing that the reasonable fear that she would be actually badly injured or killed if she resisted. At the other end of the spectrum, New Jersey holds that a woman who remains completely silent is still able to claim rape - anything that is not affirmative consent qualifies in this case.)

                              However, the woman here consented to the penetration, under certain conditions. The fact that she gave her consent under certain conditional factors under her current knowledge (that she would be paid) does not nullify her consent.

                              A confounding factor here is that prostitution itself can be completely illegal in areas. In which case, the court will generally not attempt to uphold a defective contract. (It treats the contract as though it never even occurred.)

                              Absent the contract, the woman's consent is based on a legal nullity, thus the man never had her consent. (???)

                              NB Everything I've just said could be wrong. I'm typing this in the middle of a Constitutional Law class on Abortion, and I'm also getting very hungry as I type this.
