      • I just got back from the school where at the near by HS they are having a football game. I was told that there are bus loads of protesters from around the country coming to argue at the next school board election to make sure she never teaches again...

              • I looked at the requirements for criminal neglect, which is more than the requirements for tort neglect, which doesn't require intent. Criminal neglect requires "disregard" for another persons safety. Cleary you have to be aware of someone in order to disregard their safety.

                • Her entire existence was disregarded. Wouldn't her safety be included in that?

No disregard is an intentional act. That's why it's different from forgeting or not knowing.

                      • @ Japher

On this so-called mom, the very, very least she should be charged with is recklessly endangering the welfare of the child. But I'm tending towards agreeing with the ones who advocate slamming the entire book at her and locking her up for murder. The story as it is being presented is unbelievable, and letting her off like this is laughable. But of course she's female, so it's a small wonder that the law would be so nonchalantly set aside for her.

And the DA.. ratings conscious? Sounds like he should be on Oprah in some capacity or other.

You don't forget the location of your kid. For hours.

Reckless disregard (legal sense) lies in doing, or failing to do, what a reasonable person knows or should have known ought to have done or not done.

"Forgetting" is not a defense unless a "reasonable person" in the circumstances would be likely to "forget."

You're not talking about "criminal" neglect. That's tort neglect. You can not be charged for a crime if your act was unintentional. You can be charged with a tort however if you fail in your duty.

What makes you more qualified to answer that? It's reasonable to assume that the prosecuter made a proper decision. You don't have the information that he/she had.
