        If it doesn't, and the fetus isn't a person then they can never be protected because they are not considered humans under the constitution. its not stated anywhere that potential life is life in the constitution. So it is a violation of privacy if we prevent people from having an operation that doesn't harm the person wanting it beyond what they accept.

        So what is it, the constitution is a living document that can be interpreted to protect a fetus because many people of our time think that they are, or its a dead document that doesn't because the founding fathers didn't consider a fetus a person at the time?

                      I don't think public opinion in the US was ever really for abortion, at least not in its present form. I think most people are ok with abortions in circumstances that require it such as incest, rape, or when the mother's life is in danger. When people start having abortions to select gender or because they forgot to use contraceptive then you have a problem. I won't even get started on partial birth abortions which I would think anyone who isn't completely deficient in morals would find to be outright murder.

                        Thank you for bringing this up. Even now the population opposes the absolute legality of all abortions* that has existed (until very recently) since Roe. Most of the population also opposes absolute restrictions on abortion. We're actually fairly moderate, but one reason Roe was a terrible decision was the incredible polarizing effect it's had.

                        The other reason is it's just a bad decision. It's very weakly founded in the Constitution.

                        * technically Roe permitted some restrictions, but no laws passed met its tests.

                            Hmm, interesting. Over here many seem to be OK with abortions also in case of unwanted pregnancy (as in "forgot contraceptive" as our less subtle forum member put it) And so am I, though I agree people should use contraceptives more awarely.

                              so where is the amendment that makes a fetus a person. i made the case that the judges were not activist by the rationale the used in deciding the legality of banning abortion.
