        it isn't about my ideology, its about what the Constitution says. If I cant be required to incriminate myself because that violates the 5th Amendment, why can I be coerced into filing a return that can be used to incriminate me?

            no, I just see a conflict with the 5th created by filing returns. Thats why filing is "voluntary"...

                    Man, that'd be really frightening.
                    Why? That way I dont have to pay a lawyer to figure out what I owe and then be put in jail if mistakes are made. Congress has the power to levy taxes, not coerce us to levy taxes on ourselves under penalty of law.

                      I don't think you can be thrown in jail for making a mistake on your return, only for intentional fraud.

                          Gee, who gets to decide if my mistake was innocent or fraudulent? Me, you, a jury? Nope, the IRS... You're still missing the point, filing a return incriminates the filer. That violates the 5th Amendment...

                              Berz, is your complaint i) that you are incriminating yourself on the return by legally affirming that you have a debt owed (and hence it can be used in cases of tax evasion when you don't pay said debt), or ii) that you are incriminating yourself by potentially lying on a document that you are being forced to fill in (and hence attempting tax evasion)?

                                If the tax return asks you if any of your money is illegally gained, then I can understand your concern. As is, I can't think that an incorrect return will result in anything more than a fine if done by honest mistake.
