Why underhanded? I went in, explained a situation, and told them what the best resolution from my point of view was. If they said no, I would have left and dealt directly with Apple.

You did, however, omit one vital piece of information...

        You said it best, Floyd:

Let me start by saying that I screwed Walmart out of a brand new IPOD.
Your words, not mine, and entirely accurate.

          IIRC for DF they are.

Probably not. There's only one Apple, DF.

They have the upper hand, since people don't go to Wal-Mart looking for "an mp3 player"; they go to wal-mart looking for an iPod, and if Wal-Mart doesn't have one they'll go somewhere else. Apple has the brand recognition right now.
Could be. The only thing is that if Walmart decided to pull Apple products from its shelves, Apple would be hurt a lot more than Walmart. That's because their is almost 0 profit margin in selling any Ipod, due to UMRP (Universal Manufacturer's Retail Price). The profits are going to Apple, not the retailers, on the core products. The same is true with gaming systems, by the way.

That's why bigger retailers typically have more bargaining power with manufacturers. Walmart has more than Best Buy, which has more than Circuit City, and so forth and so on.

Underhanded by implying that you bought the iPod from Walmart, and by not disclosing that it was broken because of user error.

Again, how is what I did even remotely related to theft or stealing?

1)I didn't imply any such thing. I simply said I had an Ipod but not a receipt.

2)Any responsible retailer will make at least a cursory effort to inspect and test the product. Walmart, apparently, is not a responsible retailer. They asked me what the defect was, I honestly told them, and they left it at that.

That's a failure in Walmart's business approach. No receipt required. They do it to themself.

You implied it by walking into Wal-Mart and asking for an exchange.

Certainly. But taking advantage of it is still unethical.

I didn't say it was ethical. As a retail business though, they should have the awreness to recognize that a vast majority of consumers are out to get what they can get, for nothing. No, it's not proper, but it's correct.
