Actually it's unlawful restraint. For it to be kidnapping he has to be taken against his will to another location.

And then the crap beat out of him.

although I always wondered about was citizens arrest. Or is that just something they do on TV and isn't legal in real life?

This is a case of citizen's arrest. Detaining until police can arrive.

            cit·i·zen's arrest (sĭt'ĭ-zənz)
            n.

An arrest made by a citizen, for whom legal authority arises from the fact of citizenship, rather than by an officer of the law.

It's all fun and games — until someone invariably pulls a knife or gun and uses it. If I'd been among the "flash mob," I would've sat on the bastard and left it at that. Then again, maybe I would've become "one with the mob" and gone bonkers.

mob mentality is fascinating. People do things they would never do by themselves. Like rape, torture etc.

Yes. Mobs tend to bring out the animal that's always lurking beneath the thin veneer of civilization we all project to the outside world.

Wow, a picture of a nude woman in a magazine? Those kids' lives must be ruined forever. No wonder they felt they had to beat the guy up.

It's not his decision to make; even if showing pictures was all he had in mind.

So they were justified in beating him up? That was their decision to make, right?

No, it wasn't. They were part of a mob, so individuals in a mob are absolved of any responsibility for their own actions. :sarcasm:

What I find funny about this is about an hour or so ago a "mob" of civilians managed NOT to beat the snot out of an ARMED assailant in the US Capital building, instead opting to wrestle him to the ground and hold him until police could grab him... and yet these people couldn't refrain from beating some guy showing nude pictures to children out in the open in full view of their parents?
