Biologically, yes, he's a child. Mentally, yes, he's a child. He has the brain of a child. He has the mental capacity of a child. That's why we don't let kids vote, drink, drive, have sex, etc. Especially at twelve year old!!!
The kid is obviously dangerous. The way he acted at sentencing says one of two things to me. He either doesn't fully comprehend the nature of his sentence or he's guilty as hell. Very likely both.
Don't get me wrong. What he did was monstrous. He certainly needs to be put somewhere he can't harm others. They need to find out why he did it, and see if its fixable (not that I think it is). I personally think he needs to be kept out of society for the rest of his life, since he seems serial killer material to me.
This is the real problem with the whole PUNISH PUNISH PUNISH, RUCK HIS RIGHT!!! mentality. It doesn't protect society. At age 41 he's gonna get out of prison and kill again . . . if he doesn't kill (or get killed) while in prison. God damn right-wingers care more about punishing teh guilty than they care about protecting the innocent. Now, in principle, I agree with Mrs Tubes. Ultimately, we have to take responsibility for our actions. While I don't agree with the view that some people are just "plain evil", I think that it's all to easy to hide behind excuses such as "it was [this persons] upbringing".
Of course, the fact that a person should be locked up for the rest of their days as a matter of public protection (as opposed to punishment which, against a 12 year old, is dubious at best), should not preclude the fact that that persons life is still valuable and it wouldn't be fair to prohibit them from atoning for their actions in their own way.
That said, I think we'd all be idiots if we were to pass judgement in this case. I'd imagine it's going to be highly complex, and so an article which wreaks slightly of sensationalism is hardly sufficient evidence for us to discuss this particular individual.

I can't see how you can get to age 12 in this country and not have killing=bad consequences drilled into your head. This little ****head (apperently) plotted out and killed his buddy knowing damn well that killing someone was wrong (otherwise why try to lead the police away from the body?).
If he's mature enough to figure out how to kill someone, then try to cover up, he's mature enough to know what he did was really, really wrong. Personally, I think he should be kept seperate from society for the rest of his life as well. As it is, he's going to (probably) Juvie, then prison for 26 years. Him smiling at the verdict makes me think that he thinks he's still gonna get out of it.
**** 'im. There's no way he could have gotten at this point in life and not know he was doing an awful thing. i dont know, i was 5 years old when i killed a toy dinosaur and then hid the body behind a bookcase and the head in the sandbox. I also wiped my fingerprints of the body, but they connected me via eyewitness testimony and DNA.
