Wow, 12 year old kills playmate and gets 26 years.

    I'll admit to being unsure in cases such as these. On the one hand, we're talking about a 12-yr old. On the other, what the 12-yr old did is so repugnant...

    My gut feeling is to lock him away and study him. How the HELL does a 12-yr old get like this?

      Hmm...

      I am not convinced that 26 years for a 12 year old is a good idea; but perhaps there's some reason he was tried as an adult beyond the simple details of the crime?

      What worries me more, is the other child. 14 years for 'complicity'... that sort of thing is exactly what the lack of childhood maturity/responsibility is defined by. Unless he ORGANIZED the attack, which would take away the 1st degree charge from this kid, I don't see how a kid can be tried as an adult for quite possibly being pressured into something... THAT's the stupidity here IMO.

        Probably a good idea... '26 years', but give plenty of chance of parole/probation if he is rehabilitated.

        The thing is, 26 years from now, a 12 year old will be 38 (assuming he's served 3 already) and will have had nothing but prison to remember, really. He'll likely either end up homeless or recidivating ...

          Not like he knocked the guy down, and he hit his head on a hard object. He stabbed him 1-2-3-4-5-6-7-8-9-10-11-12-13-14-15-16-17-18-19-20-21-22-23-24-25-26-27-28-29-30-31-32-33-34 times. Say it out loud.

              Would it be possible to consider every such perp individually? Have someone evaluate, whether he is mentally responsible for his actions.

                  My problem with this is the future. He's fifteen now. He'll be in prison for twenty six years. In 2032 out pops a forty one year old man who has known only one constant his whole life - violence.

                  He knows violence put him in jail, he knows violence probably kept him alive while locked up, he knows violence was committed against him for what he did.

                  He will have no life skills, as he was put into prison in the middle of his education, and he will have no concept of the world as it will be then, because so much time will have been spent on the inside.

                  I can't conceive of a way in which he will ever be a productive member of society. If you're going to steal twenty six years of life away from a boy, I don't see the point in keeping him alive at all. Might as well kill him to save time and money.

                  Or.

                  An attempt can be made to make sure that he can, at some point in the future, redeem himself and find a way to be a man in this society.

                  What's the better option?

                      An attempt can be made to make sure that he can, at some point in the future, redeem himself and find a way to be a man in this society.
                      It sounds good, but how, exactly? Are there places where this has been demonstrably successful? In the case of really violent and premeditated crimes like this, I mean?

                        Just kill him and instead of spending vast amounts on paying psychologists to "cure" his mental condition or on accommodating him in prison use the cash for something more useful.

                          Unfortunately, there probably aren't places where this has been done successfully and consistently. But I think that has a lot to do with the fact that, as a society, we don't really seem to care much about that aspect of justice.

                                I have. I think stabbing someone 34 times and beating them, a challenged youth at that, is more than a mere temper tantrum.
