      Bush to Nominate Roberts As Chief Justice

      WASHINGTON - Moving swiftly,
      President Bush will nominate John Roberts to succeed William H. Rehnquist as chief justice, a senior administration source said Monday.

      The move would promote to the Supreme Court's top job a man who currently is being considered as one of eight associate justices.

      Naming Roberts for chief justice was about the only way to ensure all nine seats on the court are filled when it begins its next term Oct. 3. If the court began a new term with only eight justices, it could have resulted in 4-4 ties on controversial cases.

      The president was to make the announcement in the Oval Office before leaving for another trip to the hurricane-battered Gulf Coast.

      Bush met with Roberts at the White House on Sunday evening for about a half an hour and then offered him the top position at the Supreme Court on Monday morning, the administration official said, speaking on condition of anonymity because Bush had not announced his selection.

      Bush already had nominated Roberts to fill the seat of retiring Supreme Court Justice
      Sandra Day O'Connor. It would just take a little paper shuffling to change the nomination for Rehnquist's seat.

      The president still wants Roberts to be on the bench when the Supreme Court resumes its work on Oct. 3, the official said. That means Bush would have to find a new nominee for O'Connor's seat. She has offered to remain on the bench until a successor is seated.

                The NOMINATION (which won't even take effect until it does or does not get approved) is not as time sensitive. The damn thing can wait a week.

                • I'm on your side, Ted. I'm quite sure many people have died because of this announcement. Bush was clearly wasting time he could otherwise have spent rescuing victims and tending to the sick. What's worse, rescue operations probably ground to a halt as people stopped to listen to Bush's announcement.

                    I live down South. I see these people in a more personal way in my daily life than on the majority of you watching it on the TV. So spare me the sanctimonious attitude.                       Wow. That's actually not a bad choice. His record sure isn't perfect, but given most of the other names that have been floated, this is about as good as we could have hoped for.

                      Now we just have to hope he doesn't try to put Gonzales in for O'Connor...

                      Why? You expect him to be shifting rubble or administering first aid? I didn't think your opinion of the guy was so high that you'd think his logistical and tactical planning skills were irreplaceable assets for the rescue work.
