The kid was grabbing his crotch as he was leaving. And pretty far away, rather than at Coulter's face. And maybe I'd forcibly eject him from the restaurant if he refused to stop or leave, but why have him arrested and charged with a crime? That's rediculous.

To me this kid went to that speech to get arrested to prove a point. he accomplished just that. had he just went there and asked a dumb question and left the auditorium with out acting like a jackass as he says he was he wouldnt have been arested.

Im sorry i see it as being the same whether your holding you penis openly then doing it through your clothes. makes no difference to me the jesture is still obscene in public. By no means am I a prude I have been a victim of idiot men doing this all the time I just simply walk away, however i have had the unfortunate incident where some dumb ass came up to me while i was with a bf and made a dumb comment and jesture like this it instilled in a fight with my bf and the other guy in which case 30 minutes later i was racing to the ER with my bf being stabbed in the chest.

Oh, and btw, this wasn't "fighting words" because there was no rioting or a situation where a riot was imminent. You can't just arrest someone for saying something foolish in a diner, there has to be an incitement of immediate of breach of the peace or the utterance itself must inflict injury (like calling someone a slur to their face).

Now if he was inciting a riot, that's different. But he wasn't, so it doesn't fall under fighting words.

He wasn't 'holding his penis', Princess. He made a 'jerk off' motion with his hand, something every guy (and plenty of women for that matter) has done, at least, once in his life. Nothing wrong with that. Whipping it out is indecent exposure and something entirely different.
