  • Cause guns are a better deterrant than truncheons, and have had to be used a few times.

Non lethal force would be better. Less chance of the guards dying that way.

I guess that coming from a country where the police aren't armed changes one's view.

    • Good to see he's off the streets

This guy has come around a bit too late to make a legend for himself IMO, even with his brief escape and death count (what is it? three? four?). In twenty years he'll be remembered by the victims' famalies and some hard core crime fanatics but not much more. Our memories are just too short and he has too much "competition" to attain the heights of a Jesse James or Bonnie and Clyde.

As for his escape, didn't Ted Bundy escape from custody in Colrado (when he was on trial for murder) and avoid capture for at least a couple months' (instead of little more then a day) before the Florida police caught him. So yes, his escape could be considered impressive but is not enough to make him a permanent celebrity IMO. Now if he escapes again.....

My sympathies to all the people this piece of dirt has hurt or killed.
If at first you don't succeed, take the bloody hint and give up.

      • Apparently he killed a US Customs Agent that he carjacked.

That makes 4 dead so far (depending on the other deputy)

        • yeah 4 people dead. The customs agent is believed to be killed by Nichols.

The woman who lost her gun is expected to live.

          • What's weird is that this was his second trial on the rape charge. The first resulted in a hung jury.

Surely that's a good sign if you are a defendant. Why he went berzerk is beyond me.

According to the ex-defense lawyer, the prosecutor was going very hard in the second trial.

              • I don't think his next trial will result in a hung jury. just a hunch.

                  Mistrial, not a hung jury.

                  • Yeah, but the foreman for the first trial said a bunch of jurors said they was reasonable doubt in their heads.

                      On what grounds?

I am a frequent Law and Order viewer, but I can't remember any of the grounds for a mistrial other than that one of the jurors falls in love with the defendant, or something like that.

                      What was it this time?

                          From article:
Nichols faced a possible life sentence if convicted in his retrial on charges of rape, sodomy, burglary, and false imprisonment, among others. His earlier trial was declared a mistrial on Monday when jurors voted 8-4 for acquittal.

                          • Yeah, it seems they got confused. It was a hung jury. From CNN.com (to suppor Tuberski's quote:

Nichols was being retried on rape, false imprisonment and other charges after a first trial last week ended in a hung jury.

                            • I thought that if the jury can't come to a decision that it is harder to get another mistrial, since it's good reason to think that reasonable doubt has not been met.

                              • Oh well. The TV hasn't been making a real big deal about it (I'd have thought a hung jury would have gotten more play) and I thought it was for procedural errors.
