    They are prosecuting based on sharing, as usual - but not proven sharing, rather potential sharing. He had the music in a shared folder, where anyone with access to his computer might have grabbed them. RIAA is suggesting this is just as bad as putting them on Kazaa etc.

    It's idiotic, but it's not prosecuting for ripping music from a CD. That is explicitly fair use, based on court precedent...

      Thanks for the clarification... And, as you said, still idiotic.

      But, IMHO, it's a lost cause… They can’t stop the time. And useless, this can’t stop the industry crisis.

        They (or someone) initially argued that ripping music from a CD was a violation, yes. At the time there was some issue as to whether buying a CD (or DVD or ...) gives you the right to utilize that CD/DVD/etc. in any format that is convenient for you, or whether it means you must use it in the format you purchased it in.
