I´m not so sure. Even if the intention to cross the border is a preparation to war, the actual declaration shouldn´t come until your troops or missionary is right on the border. There´s no advantage in giving the enemy a heads up long before you actually arrive. But the easy solution to this is of course to send your unit to a point just outside your enemys borders. Then you can spring the surprise...I love being beaten by women - Lorizael

If I am expecting to somehow arrange open borders by the time the missionary gets to the border, then the thing to do is to move the missionary up to the border and then try to cross the line.
1. Sending your missionary just outside of somebody's border, then try to get an Open Borders agreement.
2. Sending him straight in, and remember to secure an Open Borders agreement before you accidentally trigger a war.

The act of war is not sending the unit into another nation, the act of war is the unit actually entering another nation without Open Border. The missionary was nowhere near Mogolia and it should never have been a declaration of war on my part.
It could be handled better though.
