A reasonable inquiry.
The original approach to the Upload Policy was hardline to files and in turn users deemed in violation of them. If there was no clear way from the file and the file alone to identify it as falling within the confines of this Policy, it was considered a violation -- file deleted, user penalized; the penalty was almost always a ban and only a ban, and on average 24hrs. in length. No PMs were sent to the impacted user.
What inspired a move away from this hardline approach? A few understandable but characteristically unfortunate misinterpretations, most of which have been summarized in this thread already. No misinterpretations have resulted since.

No, but I've been banned on other forums. Even in real life I want to have the last word, and my natural inclination to be the devil's advocate leads me to get into arguments that I don't honestly care about.
Plus, I'm not the standard type of guy who goes on online forums, so when I speak up, it tends to go against the grain.
I could've gotten banned from here, since the last couple times I got here I forgot I had an account, posted for a couple months, and realized I had this account. I distinctly remember PMing DanQ at least twice about "hey, could you delete ESpark and put those posts under EternalSpark for me, please?"
2. I found a leak in the forum software and was able to give myself the 'Administrator' title. I immediately posted about it in the apolyton forum to tell the mods and to just make a bit fun like: "W00t, I'm an admin now ". Markos banned, me eventhough I helped him patching the leak.
3. Ming banned me once because during the Civ3 time Firaxis was famous for releasing America-only patched. When I completely frustrated posted "Will we, europeans, get the patch as well or should we hack it straight away?". No mercy for those who were without a patch for months
I think I score a full 3 out of 3 pathatic ban-score

I remember one was about cheese, and another about Pinky and The Brain. Ming PMed me to stop or else, and I didn't see the PM until I was banned. I apologized, and the ban was lifted.

That would have been some time ago now, and such violations are no longer treated so harshly.
Yep - I got caught in the upload ban as well. Similar to UnO's situation, I was uploading pictures of my hiking in the Rockies to use as a pictoral story line for Vox Controli's exodus from its homeland. Not sure why Markos or Dan couldn't make that connection.
And oh yes - there was a little emotional dust-up with my good friends on the Horde, but that is all ancient history now.
