I always find it funny when the people who have the biggest hard-on for the Constitution are so willing to set it aside when immigrants come up. The Founders were unusually explicit in leaving matters of naturalization and regulating non-naturalized aliens within the federal power, and it wasn't by accident. If you don't like it, amend it.

They aren't charging them with illegal entry to the US, but with trespassing on STATE property without valid identification.

State property? Where in the article did you find anything about state property? As I read it, the law applies to anybody IN THE STATE stopped by the cops.

And thus this is a blatantly unconstitutional grab by Arizona for powers given to the federal government, namely the control of borders, immigration and citizenship.

What a joke. As I said, the first time this comes before a judge he will open his constitutional law textbook to page 1 to make sure he's not living in some sort of alternate universe where this would be constitutional, then hand down a summary judgment for the defense.

Instead of accepting some johnny come lately DL's word for what the proposed law reads, why don't you scan the article yourself? There is absolutely no mention of state property anywhere in it. The proposed law applies to anybody within the borders of the state. It is not merely a law requiring proper ID for anybody in State parks etc.

It is not ignoring the Constitution. The Constitution is to protect the rights and freedoms of all citizens of the United STATES of America. Not for the Federal government to dictate to states how to conduct their laws and business. The leftist lean is that states cannot decide how to best protect their interests, that it should be left up to the Federal government. The rightist lean, and even us outside the 2 parties, KNOW that the Federal government was created to protect the borders and the rights of the people. .... let that sink in...protect the borders. Well guess what boys and girls on the left, obviously some of us do not see what the Federal government is doing is enough, so states hold their rights to implement laws that will protect their borders and their peoples, they are well within the Constitution and well within their rights to act in the favor of their constituents. I am not picking and choosing what amendments I want to follow...if you think I am, please quote which amendment, which paragraph in the Bill of Rights, or in any of the papers that I am circumventing?

Um...section 8...Powers of Congress. Well if you would like to site specifically which clause you seem to believe regulates states not being able to have laws on trespassing please do.

Regulation of commerce with other nations, establishment of uniform laws of naturalization through the land, to provide for the common defense and general welfare.

States do not get to intrude on the prerogatives of the federal government.

Oh yea, KH... remember I did swear an Oath to protect the Constitution and the free people of the US. I know the Constitution, actually I have a copy of it on my desk at home, and a copy of the Bill of Rights, Articles of Confederation, and some of the Federalist papers. So you can question my knowledge of our founding documents all you want. I know what I am talking about.
