And the incumbent is running for re-election, not sure it matters, doesn't to me. But it is a difference. I thought Garland was screwed, these hypocritical partisan games do not instill confidence in the system. Otoh if the Constitution doesn't require 9 judges then have 8 - that would mean a 5-3 or 3-5 minimum requirement for cases making decisions a bit more definitive than 5-4 decisions.
