      The issue at hand is really a relevant one. Are the courts losing their power to curb executive action? That issue could easily become a national one. Obama has pushed his executive powers right up to the line (and some would say has crossed the line). This trend will probably continue now that it has started in earnest. The bigger question isn't really just about Kansas, but about the courts role in curbing executive power...and it is a question that needs an effective answer.

        It's the same answer it always was. Best 2 out of 3. Executive vs Judiciary is decided by the Legislature.
