 MrFun: IMO the appropriate thing to do here is to either say "yeah FDR was a douche for dicking around with the court," or to say "FDR was justified in dicking around with the court because [insert reasons here]."  Tend to agree, although the article suggests that FDR taking the stance he did pushed the court into being more willing to accept the right of elected politicians to pass legislation too.  If the state constitution mandates "adequate levels of school funding" then presumably there is some minimum level of school funding that they can't go below. I don't know how they determine what "adequate levels" are.The current battle began in 2010, when a coalition of school districts sued the state, seeking to force the Legislature to reinstate school funding that was cut during the Great Recession, under a provision of the state constitution that mandates adequate levels of school funding.
