          Yeah. Not sure what FDR's action with U.S. Supreme Court has to do with this, but if TMM wants to run with that, who am I to stop him?

              I think it fell out the right way. The court is there to keep a check on headlong rushes that cause more damage than they cure. Same for here, Kansas legislature should leave the court alone.

                  MrFun: IMO the appropriate thing to do here is to either say "yeah FDR was a douche for dicking around with the court," or to say "FDR was justified in dicking around with the court because [insert reasons here]." Saying "I have no idea why you're comparing one instance of dicking around with the court with another instance of dicking around with the court" is disingenuous at best.

                    Tend to agree, although the article suggests that FDR taking the stance he did pushed the court into being more willing to accept the right of elected politicians to pass legislation too. Seems like a pretty awesome result all around.

                      Isn't it easier to simply repeal whatever law the court is using to say that the school budget should be on autopilot without input from the state legislature?

                            If the state constitution mandates "adequate levels of school funding" then presumably there is some minimum level of school funding that they can't go below. I don't know how they determine what "adequate levels" are.
